These Clinic Portal Terms supplement the general Terms of Service and apply to clinics, their administrators, providers, and staff (collectively, "Clinic Users") who access the clinic.aminostackiq.com portal (the "Clinic Portal").
1. Provider responsibility
The Clinic Portal supports licensed practitioners in their independent clinical decision-making. Amino Stack IQ does not practice medicine. Providers are solely responsible for diagnosis, treatment plans, prescriptions, monitoring, and informed consent.
2. Protected Health Information (PHI)
Clinic Users may upload PHI subject to HIPAA. Amino Stack IQ acts as a Business Associate under the Business Associate Agreement (BAA) incorporated by reference. The Clinic is the Covered Entity and remains responsible for lawful collection, minimum-necessary disclosure, and patient notices.
3. User accounts & access
- Each provider and staff member must have a unique account; credential sharing is prohibited.
- Clinic admins are responsible for promptly deactivating departing staff.
- Role-based access controls must not be circumvented.
4. Patient data
- Clinic Users will only upload patient data they are authorized to process.
- Patient data subject access requests (DSARs) can be initiated at /clinic/dsar.
- Audit logs of access to patient data are retained per the Compliance page.
5. Fees
Subscription fees, processing fees, and any revenue split apply per the pricing page for clinics and the order form. Fees are billed monthly in advance unless agreed otherwise.
6. Acceptable use (clinic-specific)
- No use of the Clinic Portal to provide care outside the provider's scope or jurisdiction.
- No marketing communications to patients without lawful basis and applicable consent.
- No upload of data unrelated to the Clinic's bona fide care operations.
7. Suspension
We may suspend Clinic User access for security threats, non-payment, or material breach, with notice where practicable.
8. Termination & data return
Upon termination, the Clinic may export patient and operational data for thirty (30) days, after which we will delete or de-identify the data per our retention schedule and the BAA.
9. Compliance with law
Clinic Users will comply with HIPAA, state medical practice and pharmacy laws, the federal Anti-Kickback Statute where applicable, and all other applicable laws.
10. Order of precedence
In the event of conflict: order form / BAA > these Clinic Portal Terms > general Terms of Service.
